By accessing or using attarha.homes (the "Site"), you agree to these Terms. If you do not agree, please do not use the Site.

What changed in this version. The Site now shows listings, an address report, home values and member accounts. §3 to §5 cover them, new §8 to §10 cover accounts, sharing with a partner and uploaded files, and the privacy summary (now §12) matches the Privacy Policy again. The earlier disclaimers are unchanged.

1. Who we are

This Site is operated by Attarha Homes.

2. No offer, no guarantee, not advice

Content on the Site, including guides, checklists, blog posts, neighbourhood pages, listings, reports, and calculators, is provided for general information and education. It is not legal, tax, accounting, financial, or investment advice, and it is not a substitute for advice from a professional who knows your circumstances.

Nothing on the Site is an offer to buy or sell real estate, or a solicitation where such an offer would be unlawful.

3. Tools and calculators

Our mortgage, affordability, and related calculators produce estimates only. Results depend entirely on the assumptions and figures entered, and may not reflect actual lender terms, fees, property taxes, insurance, HOA dues, PMI or MIP, credits, or closing costs.

Interest rates shown are published benchmark averages sourced from the Freddie Mac Primary Mortgage Market Survey via the Federal Reserve Bank of St. Louis (FRED). Each figure is displayed with the date it was observed. A benchmark average is not a loan quote and is not an offer of credit. Your rate depends on your credit profile, the loan type, points, and lender pricing. For an accurate quote, speak to a licensed lender.

A saved budget, and the comparison of homes against it, uses the same estimates. A lender decides what you can borrow, not the Site.

The address report shows flood, earthquake, wildfire, environmental-site and rent data published by federal agencies, as it stands at the time you look. It is general information. It is not a Natural Hazard Disclosure report, an inspection, or a survey, and it does not replace the disclosures a seller must give you or the reports you may order before you buy.

Home values are estimates, whether they come from a property-data service, from a comparison of recent sales, or from our own judgement. A home value is not an appraisal and may differ from what a lender's appraiser, a buyer, or the county assessor would say. Estimates from other companies are theirs, shown as they gave them.

4. Neighbourhood and market information

Market statistics, school information, commute times, and neighbourhood descriptions are drawn from third-party sources, which we name and link alongside the figure, together with the date it was observed. Some figures are marked as estimates, and are labelled as such where they appear.

This information may be delayed, incomplete, or superseded. Verify anything you intend to rely on. School attendance areas in particular are assigned by address and change over time, confirm with the school district directly.

5. Listings

The listings shown on the Site are a selection we chose, with information taken from the Multiple Listing Service. The full MLS search is run by an independent MLS search partner under its own terms and privacy policy, with its own separate account system. We do not control it.

Listing information, including price, status, size, and school assignments, may be delayed, incomplete, or inaccurate, and a home may already be under contract or sold. Verify anything you intend to rely on. Homes we put in your Recommended Properties are suggestions, not advice that a home suits you.

6. Third-party links and content

The Site links to third-party websites and sources. We do not control them and are not responsible for their content, accuracy, policies, or practices. Following a link is at your own risk, and the other site's terms and privacy policy apply once you arrive.

Photographs on the Site are used under their respective licences. Attribution and licence details are published on our Photo credits page.

When you submit information through a form on the Site, you agree that:

You may create a free account. You agree to give us true details, keep your password to yourself, and tell us if you think someone else has used your account. One account is for one person. You can ask us to delete it at any time. We may suspend or close an account that breaks these Terms.

9. Sharing with a partner

You may invite a partner to see your My Home Search, Recommended Properties, and Affordability budget. You choose whether they can only look or can also change your My Home Search and budget. You are responsible for whom you invite and for what you let them change; you can change their access or remove them at any time.

10. Files you upload

Upload only files you have the right to share with us. Do not upload anything harmful, unlawful, or that belongs to someone else without their permission. We may refuse or delete a file that breaks these Terms. We use your files only to help you.

11. Communications consent

By submitting your contact details and ticking the consent statement, you authorise us to contact you by phone, email, and/or text about your enquiry and our real estate services.

Message and data rates may apply. You may opt out of texts by replying STOP, or by contacting us directly. You may opt out of marketing email using the unsubscribe link in any message.

Consent is not a condition of buying or selling real estate with us.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes what we collect and what we do not. In short: this Site runs no advertising trackers. It counts visits itself, without cookies and without storing your IP address. It sets cookies only to remember a choice you made under "Cookie choices" or to keep you signed in. Google (address suggestions, the listings map) and YouTube (blog videos) are involved only where the Privacy Policy says, and you can switch them off from the "Cookie choices" link in the footer.

13. Intellectual property

Site content, text, graphics, logos, photographs, layouts, and code, is owned by us or our licensors and protected by intellectual property law. You may view and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, or exploit Site content without written permission.

Third-party photographs remain the property of their creators and are used under the licences recorded on the Photo credits page. The RE/MAX name and logo, the REALTOR® mark, and the Equal Housing Opportunity logo are the property of their respective owners and are used under licence or applicable membership terms.

15. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT.

Our total liability for any claim related to the Site will not exceed $100, or the amount you paid us to access the Site, whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law.

17. Indemnification

You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Site.

18. Fair housing and equal opportunity

Attarha Homes complies with the federal Fair Housing Act and California fair housing law. We do not discriminate on the basis of race, colour, religion, sex, disability, familial status, national origin, or any other protected characteristic. Neighbourhood content on this Site is provided as factual, attributed information and is not a recommendation about who should live where.

19. Accessibility

We aim to conform to WCAG 2.2 Level AA. See our Accessibility Statement, including how to contact us if any part of the Site is not accessible to you.

20. Changes to these Terms

We may update these Terms. The "Last updated" date reflects the current version, and material changes will be noted at the top of the document. Continued use after a change means you accept the updated Terms.

21. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
